Cops: Teens' Late-Night Swim Garners Trespassing Arrest

Update: Charges against two teens were dismissed.

According to Bernards Twp. Police, on Aug. 15 two teens trespassed the Hills Highlands Association Pool and went for a late-night swim.

Brett Lushkis, 19, and a 16-year old male were both arrested in the clubhouse next to the pool, police said.

An attorney for Lushkis, Shaun I. Blick of Caroll, McNulty & Kull, with offices in Basking Ridge and New York City, said the complaint was ultimately dismissed against both Brett Lushkis and the juvenile.

A Charleston Court resident notified police at 11:45 pm. Sgt. Scott Ward and Officer Gina Loschiavo responded to the pool, located on Hansom Road, according to a police report. Upon their arrival, the police observed the two teens swimming in the pool, the  report said.

The report also stated that the clubhouse was closed and all gates surrounding the pool were locked. The two teens exited the pool, police said, and entered the clubhouse shortly after the authorities arrived at the scene.

 Ward was able to gain entry into the clubhouse through an unlocked side door, the report said. Ward placed both individuals under arrest after gaining entry into the clubhouse.

Lukshis, was issued a citation for defiant trespass and released, according to the report. The juvenile was transported to his residence per his parents' request. A defiant trespass charge is pending for the juvenile.
